The Bypass Decision In Public Deals مقرر التجاوز في الصفقات العمومية

Résumé: يهدف هذا المقال إلى تسليط الضوء على مقرر التجاوز في الصفقات العمومية كآلية لتجاوز عمل اللجنة الولائية للصفقات العمومية, فقد منح تنظيم الصفقات العمومية لمسؤول المصلحة المتعاقدة ممثلا في الوالي بالنسبة لصفقات الولاية بتجاوز نتاج العمل الرقابي للجنة الولائية بمقرر معلل بناء على تقرير المصلحة المتعاقدة وطبقا لشروط محددة, ويتم اتخاذ المقرر في حالة رفض منح التأشيرة من طرف اللجنة الولائية لأسباب تتعلق بمخالفة الأحكام التنظيمية, وهو ما حددته المادة 200 من المرسوم الرئاسي 15-247. This article aims to shed light on the bypass decision in public deals as mechanism to bypass the work of the department committee for public deals, it has given the regulation of public deals to the contracting authority official represented by the governor in relation to department deals to bypass the results of control activities of the department committee by reasoned decision based on the report of the contracting authority and according to specific conditions, and the decision is taken in the event of refusal to grant the visa by the state committee for reasons related to violating the regulatory provisions, which is defined by article 200 of presidential decree 15-247.
