جريمة المضاربة غير المشروعة و آليات مكافحتها في ظل القانون 21-15

Résumé: إن القانون المتعلق بالمضاربة غير المشروعة جاء للتصدي للمضاربين الكبار ا أعلنو الحرب على المواطن وجعلو من القدرة الشرائية أحسن أرضية لتهديد استقرار بعضالمجتمع ، وان هذا القانون تم إعداده في ظرف متميز ، مع الإشارة إلى أن ندرة لظواهر المواد الأساسية التي عرفتها البلاد هو عمل مدبر وهذا القانون جاء لمحاربة هذه ا وبالتالي فان صرامة العقوبات التي تضمنها القانون 15/21عادية وغير مبالغ فيها في حق كل مرتكب للأفعال المجرمة بموجبه ، بالإضافة إلى اعتماده سياسة وقائية وعلاجية خرىعن طريق اعتماد إست ا رتيجية وطنية في ذلك وخول الصلاحيات لجهات مركزية و أمحلية لمجابهة هذه الظاهرة والحد من الوقوع فيها ، لتبقى مسألة تطبيق القانون 15/21 Summary : The lawrelated to illegalspeculation came to confront the bigspeculators whodeclaredwar on the citizen and made purchasing power the best ground for threatening the stability of society, and thatthislawwasprepared in a privilegedcircumstance, notingthat the scarcity of some basic materialsthat the country knewis a premeditatedact and this The law came to combat these phenomena, and therefore the severity of the penalties included in Law 15/21 is normal and not exaggeratedagainsteveryperpetrator of the acts criminalizedaccording to it, in addition to adopting a preventive and curative policy by adopting a national strategy in this regard and assigningpowers to central and local authorities to confrontthisphenomenon And limitingfalling intoit, sothat the issue of applying Law 15/21 remains a matter of reality and diligent work on the part of the competentauthorities in this regard.
