الدفع بعدم الدستورية في ظل القانون العضوي 18-16: رهان جديد للرقابة على دستورية القوانين في الجزائر

Résumé: تبنت الجزائر من خلال دساتيرها المتعاقبة الرقابة السياسية على دستورية القوانين عن طريق المجلس الدستوري، كآلية تكفل احترام مبدأ سمو الدستور باعتباره أهم مقومات دولة القانون، مقيدة عمله بآلية الإخطار الممنوحة لفئات رسمية محددة على سبيل الحصر اختلفت بين فترة وأخرى. سعيا من المؤسس الدستوري إلى تفعيل رقابة المجلس الدستوري، تبنى بموجب التعديل الدستوري لسنة 2016 آلية إخطار المجلس الدستوري عن طريق الدفع بعدم الدستورية كصورة وحيدة للرقابة البعدية على دستورية القوانين، استئناسا منه بعدد من التجارب العالمية الناجحة فاتحا بذلك المجال واسعا للمشاركة الشعبية في الرقابة على دستورية القوانين، وقد صدر القانون العضوي رقم 18-16 موضحا شروط وإجراءات تطبيق هذه الآلية. Algeria has adopted through successive constitutions political control over the constitutionality of laws through the constitutional council as a mechanism to ensure respect for the principle of the constitution as the most important elements of the state of law by restricting its work to the notification mechanism granted to specific official categories that change from time to time. In order to activate the constitutional council’s control, the constitutional amendment of 2016 adopted the mechanism of notification to the constitutional council by way of objection of unconstitutionality as a sole form of post-control of the constitutionality of laws. The Organic law No. 18-16 was issued to explain the conditions and procedures for applying this mechanism.
