صيانة التنوع البيولوجي أساس التنمية المستدامة -مقاربة قانونية-

Résumé: تشكل صيانة التنوع البيولوجي وترشيد استخدام خدماته ومنافعه بشكل مستدام مقاربة تقضي إلى إرساء وإعمال مقتضيات التنمية المستدامة في شتى أبعادها ومحدّداتها (الإقتصادية، الإجتماعية والبيئية)، وهذا إستنادا إلى مختلف النصوص القانونية والخطط الإستراتيجية والمقررات الرسمية المعتمدة في خضم منظومة الأمم المتحدّة ذات الصلة بالبيئة والتنمية المستدامة، وبالخصوص إتفاقية الأمم المتحدّة للتنوع البيولوجي، التي أقرت كلّ الإقرار أنّ التنوع البيولوجي أساس التنمية المستدامة. ومن هذا المنطلق تهدف هذه الدراسة إلى تسليط الضوء على الإطار القانوني كقيمة مضافة لإعمال خدمات التنوع البيولوجي وإسقاطها على أبعاد التنمية المستدامة بشكل ناجع، إعتبارا أنّ البيئة باتت من المسائل الفنية المستجدّة والجديرة بالعناية والإهتمام في حقل العلوم القانونية. Conserving biological diversity and rationalizing the use of its services and benefits in a sustainable manner is an approach that leads to the establishment and implementation of the requirements of sustainable development in its various dimensions and determinants (economic, social and environmental), and this is based on various legal texts, strategic plans and formal decisions adopted within the United Nations system related to environment and sustainable development, and in particular the United Nations Convention on biological diversity, which fully recognized that biological diversity is the basis of sustainable development. From this point, this study aims to shed light on the legal framework as an added value for the implementation of biological diversity services and projecting it on the dimensions of sustainable development in an efficient manner; considering that the environment has become one of the emerging technical issues that deserve attention in the field of legal sciences.
