الأهداف الحديثة للنظام العام في القانون الإداري (حالة النظام العام البيئي)

Résumé: الملخص: لقد تناولت الدراسة موضوع النظام العام البيئي، حيث يعد الحفاظ على البيئة موضوعا حديثا يدخل ضمن الأهداف الحديثة للنظام العام في القانون الإداري. حيث تطرقت الدراسة إلى ماهية النظام العام البيئي من حيث الإطار المفاهيمي وموقف المشرع الجزائري من فكرة النظام العام البيئي، بالإضافة إلى وسائل و آليات حماية النظام العام البيئي و هذا بدراسة الوسائل القانونية الوقائية كالترخيص ،المنع ،الإلزام، الترغيب، دراسة التأثير ونظام التقارير أما الوسائل القانونية الردعية لحماية النظام العام البيئي تتمثل في الإخطار، سحب الترخيص، الجباية البيئية، وقف النشاط، وهذا من جهة ومن جهة أخرى الأجهزة والهيئات المكلفة بحماية النظام العام البيئي على المستوى المركزي لتعرف على الدور القيادي لوزارة البيئة و باقي الوزارات، أما على المستوى المحلي نتطرق إلى مساهمة البلدية و الولاية بالإضافة إلى المديريات والمفتشيات الولائية في حماية البيئة مع إظهار الدور الهام التي تمارسه الجمعيات لحماية النظام العام البيئي Résumé : L'étude a porté sur la question du système public environnemental, la préservation de l'environnement étant un sujet récent qui s'inscrit dans les objectifs modernes du système public en droit administratif. L'étude a abordé la nature du système public environnemental en termes de cadre conceptuel et la position du législateur algérien à vis a vis le système public environnemental. Ainsi que les moyens et mécanismes de protection de ce système. Cela en étudiant les moyens juridiques préventifs tels que l'autorisation, la prévention, la contrainte, l'incitation, l'étude d'impact et le système des rapports. Quant aux moyens juridiques de dissuasion pour protéger l'ordre public environnemental, il est représenté dans la notification, le retrait de l'autorisation, l'environnement collecte et l'arrêt de l'activité, d'autre part, les agences et organismes chargés de la protection de l'ordre public environnemental au niveau central de se renseigner sur le rôle pilot du ministère de l'Environnement et l'ensemble des ministères, Au niveau local, nous abordons la contribution de les collectivités locales, et les directions et inspections étatique , à la protection de l'environnement, et en montrant le rôle important joué par les associations dans le cadre de la protection de l'ordre public environnemental. summary : The study focused on the issue of the public environmental system, the preservation of the environment being a recent subject that falls within the modern objectives of the public system in administrative law. The study addressed the nature of the public environmental system in terms of a conceptual framework and the position of the Algerian legislator vis a vis the public environmental system. As well as the means and mechanisms of protection of this system. This by studying the preventive legal means such as authorization, prevention, coercion, inducement, impact assessment and the reporting system. As for the legal means of dissuasion to protect environmental public order, it is represented in the notification, the withdrawal of the authorization, the environment collection and the stopping of the activity, on the other hand, the agencies and organizations responsible for the protection of environmental public order at the central level to learn about the pilot role of the Ministry of the Environment and all the ministries, At the local level, we address the contribution of local authorities , and the departments and state inspections, environmental protection, and showing the important role played by associations in the protection of environmental public order.
