الرقابة القضائية على أعمال سلطة الضبط السمعي البصري

Résumé: أثارت دراسة الرقابة القضائية على أعمال سلطة الضبط السمعي البصري مجموعة من الملاحظات التي تبين كيف كان مجلس الدولة هو المختص بمراقبة نشاطات سلطة الضبط السمعي البصري في ظل القانون العضوي رقم 98-02 المتعلق بالمحاكم الإدارية والقانون العضوي رقم 98-01 المتعلق باختصاص مجلس الدولة وتنظيمه وعمله وكذا الدستور 1996 الذي نص على ذلك، إلا أنه بعد تعديلات 2022 سُحبت اختصاصات المراقبة من مجلس الدولة لفائدة المحكمة الإدارية للاستئناف بالجزائر العاصمة. الكلمات المفتاحية: الرقابة القضائية، سلطة السمعي البصري، القانون الجزائري، القاضي المختص، مجلس الدولة. Abstract : The study of judicial control of the actions of the audiovisual regulatory authority has raised a set of findings which show that the Council of State has jurisdiction over the activities of the audiovisual regulatory authority under Organic Law No. 98-02 relating to administrative jurisdictions and Organic Law No. 98-01 on the jurisdiction and organization of the Council of State and its actions, as well as the 1996 constitution which stipulated it, except that after the amendments of 2022, the powers of control were withdrawn from the Council of State in favor of the administrative court of appeal of Algiers.
