معيار الخطأ الطبي في فقه القانون المدني والفقه الإسلامي

Résumé: ملخص: تستعرض هذه الدراسة معيار الخطأ الطبي في كل من فقه القانون المدني والفقه المدني الإسلامي، في مقاربة تحليلية مقارنة، تشير إلى نقاط الاتفاق والاختلاف بين الفقهين، ودورهما في رسم حدود المسؤولية المدنية في المجال الطبي. حيث تبين في مبحثها الأول مفهوم الخطأ الطبي في فقه القانون المدني وما ارتبط بفكرة الخطأ الطبي من تطورات نظرية وتشريعية، وتعرض مفهوم التعدي الطبي في الفقه الإسلامي. بينما تبين في مبحثها الثاني معيار الخطأ الطبي في فقه القانون المدني؛ ما بين معيار عام وبين التمييز بين الحادثة الطبية والإخفاق في العلاج. ثم تتناول ضوابط التعدي الطبي في الفقه المدني الإسلامي وما ارتبط به من مسائل، وبيان أن ضابط التعـدي هو مادي حسب الاتجاه السائد في الفقه الإسلامي. Abstract : This study reviews medical error criteria in civil jurisprudence and Islamic civil jurisprudence, in a comparative analytical approach, indicating the points of agreement and difference and their role in drawing the scope of civil medical liability. The first section shows the concept of medical error in civil jurisprudence; and some related issues; as theoretical and legislative developments, and displays it in the Islamic jurisprudence. while the second section clarifies the criteria of medical error in the jurisprudence of civil law; which lies in between general criteria and specific distinction between medical incident and failure of treatment. Then, it deals with the matter in Islamic civil jurisprudence and its related issues with indicating that has material criteria according to the prevailing trend.
