أية فعالية لإجراء التصريح بالممتلكات في الوقاية من الفساد ومكافحته

Résumé: ملخص: إن اتساع ظاهرة الفساد وانتشارها بشكل سريع في كل القطاعات أصبحت هاجس كل الدول، والجزائر كغيرها من الدول استشعرت بمخاطر هذه الظاهرة فسارعت كغيرها من الدول للمصادقة على اتفاقية الأمم المتحدة لمكافحة الفساد، ولتكريس المبادئ المتضمنة في الاتفاقية أصدرت الجزائر القانون رقم 06-01 المتعلق بالوقاية من الفساد ومكافحته المعدل والمتمم، ألزم من خلاله كل موظف عمومي يتولى وظيفة في الدولة بالتصريح عن ذمته المالية من أملاك عقارية أو منقولة سواء تلك الموجودة في الجزائر أو في الخارج ويكون ذلك إما أمام الهيئة الوطنية للوقاية من الفساد ومكافحته أو أمام الرئيس الأول للمحكمة العليا، وفي حالة عدم الالتزام بالتصريح أو القيام بتصريح كاذب فإن الموظف يتعرض لمجموعة من العقوبات، نهدف من خلال هذه الدراسة إلى إبراز أهمية هذه الآلية في مكافحة الفساد الإداري والتطرق إلى المعوقات التي تواجه تطبيق هذه الآلية وكذا التطرق للجزاءات المتعلقة بمخالفتها. Abstract: The expansion of the phenomenon of corruption and its rapid spread in all sectors has become the concern of all countries, and Algeria, like other countries, sensed the dangers of this phenomenon and hastened, like other countries, to ratify the United Nations Convention against Corruption, and to consolidate the principles contained in the agreement, Algeria issued Law No. 01-06 on prevention Corruption and its amended and complementary fight, through which it obligates every public official who assumes a position in the state to declare his financial assets from real estate or movable property, whether those in Algeria or abroad, and this is either before the National Authority for the Prevention and Combating of Corruption or before the First President of the Supreme Court, and in In the event of non-compliance with the statement or making a false statement, the employee is subject to a set of penalties, Through this study, we aim to highlight the importance of this mechanism in combating administrative corruption and to address the obstacles facing the application of this mechanism, as well as to address the penalties related to its violation.
