التصريح بالممتلكات: آلية فعالة للوقاية من الفساد أم مجرد إجراء شكلي

Résumé: تتناول هذه الدراسة التصريح بالممتلكات كآلية للوقاية من الفساد في القانون الجزائري، وذلك من خلال التطرق إلى الأحكام القانونية والتنظيمية التي تحكمه من حيث: نطاق التصريح بالممتلكات، إجراءات التصريح بالممتلكات، جزاء الإخلال بالتزام التصريح بالممتلكات. كما تتطرق الدراسة أيضا إلى مدى قدرة آلية التصريح بالممتلكات على الوقاية من الفساد، من خلال مناقشة مدى كفاية النصوص القانونية والتنظيمية على ضمان تفعيل هذه الآلية لتحقيق الشفافية في الحياة السياسية والشؤون العمومية، وصون نزاهة الموظفين العموميين المكلفين بالخدمة العمومية. وأخيرا تتوج الدراسة ببعض الملاحظات والاستنتاجات حول الموضوع، وببعض الاقتراحات التي يمكن أن تسهم في الارتقاء بهذه الآلية حتى تحقق الغرض الذي أنشئت لأجله. كلمات مفتاحية: التصريح بالممتلكات، الموظفون العموميون، الوقاية من الفساد. This study tackles the asset declaration as a mechanism for the prevention of corruption in Algerian law, by addressing related legal dispositions and regulations: the scope of asset declaration, the procedures of asset declaration, and the sanction for a breach of this obligation. This study also addresses the ability of the asset declaration on the prevention of corruption, by discussing the adequacy of current legal dispositions and regulations to ensure this mechanism in political and public life, and safeguarding integrity of public officers charged with public service. Finally, this study culminates a few observations and conclusions on the topic, and some suggestions that can contribute to improve this mechanism to achieve its objective.
