المعاملات المالية و العقود في الجزائر خلال العهد العثماني Financial Transaction And Contracts In Algiers During The Ottoman Era

Résumé: الملخص : المعاملات المالية و العقود من الأحكام المنظمة لتعامل الناس في الأموال ، و تشمل مجالات الحياة الاقتصادية و الاجتماعية في المجتمعات عبر العصور . على غرار المجتمع الجزائري خلال العهد العثماني و من هذا المنطلق حاولنا تسليط الضوء على طبيعة هذا المعاملات و العقود من خلال استقراء عقود المحاكم الشرعيةوسجلات بيت المال من بيع و ايجار ، الإرث ، القرض وعقود الزواج و الطلاق . حيث هذه المعاملات تحتاج الى ضوابط تنظم تبادل المال و المنافع بين الناس سواء عن طريق الضابط الشرعي الذي هو الاساس أو من خلال دور القاضي الذي أشرف على تدوين العقود لتجنب الخصام والشك بين أفراد المجتمع و المحافظة على الروابط الاجتماعية وسلامة استقرار المعاملات و العقود بين الناس من الغش و الربا و هذا ما لمسناه من خلال استقراء الوثائق . Financial transactions and contracts are rules that regulate people’s dealings with money. It includes the économic and social life of individuals in societies throughout the ages, similar to Algerian society during the ottoman era. From this perspecture, we have tried to shed light on the nature of thèse transactions and contracts during this period by examing the contracts of sharia courts and public treasury, including, sales, rent, inheritance, loans, mariage and divorce contracts. As thèse transactions requise controls that regulate the exchange of money and benifits between people, wheather through the role of the judge who supervises the recording of contracts to avoid disputes and doubt between members of society, and to preserve socialties and the integrety and stability of transaction and contracts between people from fraud and usury, and this is what we noticed through the examination of documents.
