دور الإلتزام بمبدأ حسن النية في تحقيق أمن التفاوض في العقود المبرمة عبر الوسائل الإلكترونية - دراسة مقارنة-.

Résumé: إن لمبدأ حسن النية في مرحلة التفاوض التقليدي عامة والتفاوض في العقود المبرمة عبر الوسائل الإلكترونية خاصة دور حيوي في تحقيق أمن هذه المرحلة الحساسة الأمر الذي دفع بالمشرع الفرنسي بموجب تعديله للقانون المدني الفرنسي سنة 2016 بفرض مبدأ حسن النية في هذه المرحلة مع التقيد بالإلتزامين الأساسين لهذا المبدأ وهما الإلتزام بالإعلام والإلتزام بالمحافظة على سرية المعلومات، وهو أمر لم يسايره كلا من المشرعين الجزائري والمصري، فالهدف من بحثنا هذا هو تبيان أهمية إمتداد مبدأ حسن النية إلى مرحلة التفاوض التي سعى إليها المشرع الفرنسي وبالتالي نستنتح أن لهذا الأخير دور إيجابي في تعزيز أمن هذه المرحلة. :Abstract The principal of good will in the stage of traditional negotiation in general and negotiation of contracts concluded through electronic means especially a vital role in achieving the security,the french legislator to amend the french civil code in2016 to impose the principal of good will in this stage while ad hering to the two main obligations of it,namely the obligation to inform and the obligation the confidentiality of information,neither the Algerian and Egyptian legislators,the purpose of our research is demonstrate the importance of extending the principal of good will into the negotiation stage which the French legislator,has a positive role in enhancing the security of this stage
