التعاقد عبر الأنترنت: دراسة مقارنة

Résumé: إن نظام التعاقد عبر الإنترنت أصبح من الوسائل الحديثة الأساسية في التعاقد باستعمال الوسائط الإلكترونية، فما مدى الاعتماد القانوني لها، وماهي حدود وقيود هذا تعاقد عبر الشبكة؟ وعليه، جاء هذا البحث معتمدا على المنهج المقارن لتسليط الضوء على بعض الجوانب القانونية والفقهية للتعاقد الالكتروني والبحث عن سبل الحماية القانونية للفرد، وذلك من خلال مبحثين: الأول: حول التعاقد الإلكتروني عبر الإنترنت، والثاني: حول القيود والاستثناءات الواردة على هذا التعاقد. وخلص البحث إلى الإقرار بإيجابيات التعامل الإلكتروني كالسرعة ومجانية التواصل، إنما تبقى مسألة تأطير وتحديد وتحيين الضوابط الشرعية والأسس القانونية المتعلقة بهذا التعاقد ضرورة حتمية لدخولها على حياة الإنسان المعاصر. The Internet contracting system has become one of the basic modern means of contracting using electronic media, so what is the extent of its legal dependence, and what are the limits and restrictions of this contracting over the network? Accordingly, this research relied on the comparative approach to highlight some of the legal and jurisprudential aspects of electronic contracting and search for ways of legal protection for the individual, through two sections: the first: about electronic contracting via the Internet, and the second: about the restrictions and exceptions contained in this contract. The research concluded by acknowledging the advantages of electronic dealing, such as speed and free communication, but it remains a matter of framing, defining and reviving the life of modern man.
