إشكاليات تطبيق اتفاقيات تسليم المجرمين " قضية أحلام التميمي نموذجاً

Résumé: في ضوء المتغيرات التي يشهدها العالم اليوم، يسعى المجتمع الدولي نحو إنشاء آلية أكثر استقراراً وموضوعية لإقامة العلاقات الدولية، بما في ذلك تطوير وتعزيز التعاون القضائي الدولي؛ وذلك لتعقب المجرمين وعدم إفلاتهم من العقاب بتقديمهم للعدالة، ومن أهم أشكال هذا التعاون مبدأ أو نظام تسليم المجرمين, ويمكن القول أن نظام تسليم المجرمين هو عبارة عن اجراء تقوم من خلاله دولة معينة بتسليم أحد المجرمين إلى دولة أخرى, إما لمحاكمته أو تنفيذاً لعقوبة معينة متوجبة عليه, حيث تقوم الدولة الطالبة للتسليم بتقديم طلب للدولة المطلوب منها التسليم, وتقوم الأخيرة بالتدقيق بالطلب المرسل إليها والنظر في مدى توافقه مع قانونها الداخلي والقوانين الدولية, لذا كان لزاماً علينا أن نحدد طبيعة الجرائم التي تخضع للتسليم والجرائم المستثناة من هذا النظام. Abstract: In light of the current changes taking place in the world, the international community seeks to establish a more stable and objective mechanism for international relations; including improving and strengthening the international judicial cooperation in order to track down criminals and to impose punishment on them after bringing them to justice. One of the most important forms of this cooperation is the principle of extradition. It can be said that the extradition system is a procedure whereby a certain country extradites a criminal to another country, either for trial or implementation of a specific penalty imposed on him. The state that wants the criminal submits a request to the state that is required to extradite the criminal. Then the country from which the extradition is requested examines the request sent to it and examines its compatibility with its internal law and international laws. Therefore, it is important to determine the crimes that are subject to extradition and the crimes that are excluded from this system. The researchers reach a number of results, the most prominent of which is that the extradition process does not take place in all cases, as some exceptions may exist and prevent the completion of the extradition process such as nationality or political crimes, etc. They also reach the result that the system of extradition of criminals has many procedures that the requester of extradition must follow, otherwise the claim for extradition is not valid and does not have any effect.
