نظام تسليم المجرمين ودوره في تفعيل قواعد العدالة الجنائية الدولية The Extradition System And Its Role In Activating The Rules Of International Criminal Justice

Résumé: يعد نظام تسليم المجرمين من أبرز مظاهر التعاون القضائي الدولي في مجال مكافحة الجريمة وتحقيق العدالة الجنائية، وضمان عدم إفلات الجناة من العقاب، وهو أحد النظم المستقرة في العلاقات الدولية منذ زمن بعيد وأكثرها شيوعا في التطبيقات العملية، غير أن بعض الدول تتذرع بالسيادة الوطنية كحجة لعدم تسليم رعاياها، وهنا تبرز الحاجة للتعاون القضائي الدولي عبر إبرام اتفاقيات ثنائية أو إقليمية، لذلك وجب التمازج والتكامل بين القوانين الجزائية الوطنية مع المعاهدات الدولية ليحقق فعالية لهذا النظام وإقرار قواعد تسليم المجرمين. The extradition system is one of the most prominent aspects of international judicial cooperation in combating crime, achieving criminal justice, and ensuring that perpetrators do not go unpunished. It is one of the long-established systems in international relations and the most common in practical applications. The extradition of its nationals, and here arises the need for international judicial cooperation through the conclusion of bilateral or regional agreements, so it is necessary to mix and integrate national penal laws with international treaties in order to achieve the effectiveness of this system and to approve the rules for the extradition of criminals.
