الجمارك كأداة لمحاربة ظاهرة التعدي على حقوق الملكية الفكرية ذات العلاقة بالتجارة الجزائر أنموذجاً - خلال الفترة 2010 م -- 2016 م

Résumé: تثير إشكالية حقوق الملكية الفكرية ذات العلاقة بالتجارة وما يصاحبها من تعدي وقرصنة على الممتلكات الفكرية الكثير من التحديات لاسيما في التبادلات التجارية الدولية وتأثيرها على المنتجات الأصلية من حيث الحجم والسرعة. مما جعل أغلبية دول العالم تعمل على محاربة هذه التجارة غير الشرعية بوسائل عديدة من بينها قطاع الجمارك. لذلك جاءت هذه المقالة لتبيان دور قطاع الجمارك في الجزائر في محاربة المنتجات المقلدة و المقرصنة خلال فترة 2010 م لغاية 2016 م ومن أجل دراسة هذا الموضوع استخدمنا المنهج الاستنباطي بأداتيه الوصف والتحليل وهذا لتناسبه مع طبيعة الدراسة، حيث توصلنا إلى مجموعة من النتائج أبرزها أن الصين وعلى وجه العموم تعتبر المنشأ الأول للمنتجات المقلدة المصدرة نحو الجزائر، وأن القطاعات الأكثر تضررا من هذه الظاهرة في الجزائر هي منتجات التجميل، الألبسة الرياضية و كذا قطع الغيار بمختلف أنوعها. Issue of intellectual property rights related to trade , and the attendant to the infringement and piracy of intellectual property , raises many challenges, particularly in international trade exchanges and their impact on the original products in terms of size and speed. The fact that the majority of countries around the world work to combat this illegal trade in many ways, including the customs sector. This article aims to illustrate the role of the customs sector in Algeria in the fight against counterfeit and piracy products during the period 2010 to 2016. To study this topic, we used the deductive approach with its description and analysis tools. We have achieved a set of results, the most important is that China in general is the leading exporter of counterfeit products exported to Algeria, and that the most affected sectors in Algeria from this phenomenon are those related to cosmetics, sports wears products and cars spare parts.
