أثر إعمال حقوق الإنسان على مبدأ السيادة

Résumé: يعتبر مبدأ السيادة من المبادئ الرئيسية المسلم بها في القانون الدولي المعاصر التي يقوم عليها النظام الدولي الحالي، والسيادة هي المعيار الحقيقي للدولة حيث تشترك الدول مع بعض أشخاص القانون الدولي الأخرى في بعض الخصائص؛ فهي ليست وحدها ذات اختصاصات دولية، وليست وحدها ذات فعالية على مستوى العلاقات الدولية بوجود المنظمات الدولية. وتثير السيادة عدة إشكاليات منها أن كل الدول ذات سيادة وهذا يعنى تساوي الدول في السيادة، كما أنها تعني عدم التدخل في الشؤون الداخلية، لكن نطاق التدخل آخذٌ في الاتساع يوماً بعد يوم، ومن جهة أخرى فإن مفهوم السيادة يتطور في اتجاهين مختلفين حيث توجد علامات تدل على أن السيادة تتآكل باستمرار في ظل متغيرات عديدة بدأت تفرض نفسها على الساحة وهي حقوق الإنسان؛ بحيث أصبح تأثيرها فعالا اتجاه مبدأ السيادة وتوجد علامات أخرى تشير إلى اتساع وامتداد سيادة الدولة، ومن هذا المنطلق أصبح البحث في جدلية التدخل أو عدم التدخل في الشؤون الداخلية للدول جدير بالاهتمام لدى الفقه القانوني الدولي.
