الحماية القانونية للمبلغين عن جرائم الفساد في ظل الإتفاقيات الدولية و الإقليمية

Résumé: : ../../2021 تاريخ القبول: ../../2021 تاريخ النشر: ../06/2021 ملخص: يكشف المقال عن أهمية حماية المبلغين عن جرائم الفساد في الوقاية من ظاهرة الفساد و مكافحتها في ظل خصوصية هذه الجرائم التي يسودها السرية و الكتمان بالإضافة إلى تطور أساليب تبييض الأموال وإخفاء مصدرها غير المشروع. تهدف هذه الدراسة إلى تبيان أوجه الحماية القانونية المقررة للمبلغين لتشجيعهم على تقديم البلاغات على ضوء الإتفاقيات الدولية و الإقليمية المتعلقة بمكافحة الفساد . يخلص هذا البحث إلى أن نجاعة آلية التبليغ في مكافحة الفساد مرهون بنوع الحماية المقررة للمبلغين، حيث ينبغي أن تبدأ من تحفيز الأفراد على التبليغ و تمتد عبر كافة مراحل التحري و التحقيق وتستمر إلى ما بعد الإنتهاء من القضية المبلغ عنها. Abstract: The article reveals the importance of protecting whistleblowers of corruption crimes in preventing and combating the phenomenon of corruption in light of the specificity of these crimes, which are dominated by secrecy, in addition to the development of methods of money laundering and concealment of its illicit source. This study aims to identify the legal protections prescribed for whistleblowers to encourage them to submit reports in the light of international and regional conventions related to the fight against corruption. This research concludes that the effectiveness of the reporting mechanism in the fight against corruption depends on the type of protection established for whistleblowers, so that it should start from motivating individuals to report and extend through all stages of research and investigation and continue beyond the completion of the reported case.
