الحماية القانونية للمبلغين عن الفساد في القانون الدولي

Résumé: ملخص: يهدف البحث الى التعرف على الإطار القانوني الدولي لحماية المبلغين عن الفساد، من خلال تحديد نطاق ومعايير الحماية الممنوحة لهم في مختلف وثائق القانون الدولي. وقد أفضى الى نتيجة مفادها أن القانون الدولي يتطلب حماية قانونية فعالة لأي شخص يبلغ بحسن نية وبناء على أسباب معقولة الى السلطات المختصة عن معلومات يعتقد وقت الكشف عنها أنها حقيقية، وأنها تشكل فعلا من أفعال الفساد بموجب القانون الوطني، كما يحث الدول على استحداث إطار مؤسسي فعال يتضمن قنوات إبلاغ فعالة ووقائية ويضمن التحقيق في أفعال الفساد المزعومة وفي شكاوى الإجراءات الانتقامية المقدمة من طرف المبلغين، ولأن التصور الثقافي للمبلغين قد يشكل عائقا كبيرا أمام الإبلاغ، تؤكد وثائق القانون الدولي أن هذه الدلالة الثقافية تستوجب الأخذ بالاعتبار عند تطوير وتنفيذ تشريعات حماية المبلغين عن الفساد. الكلمات المفتاحية: الحماية القانونية، المبلغين, الفساد، الإفصاحات، الأعمال الانتقامية. Abstract: The research aims to identify the international Legal framework for The Protection of Whistleblowers by defining the scope and standards of protection granted to them in the various documents of international law. The research asserts that international law requires encouraging and facilitating whistle blowing by providing effective legal protection to anyone who reports in good faith and on reasonable grounds information to the competent authorities that he believes at the time of its disclosure is true, and that it constitutes an act of corruption under domestic law, and states should create an effective institutional framework It includes effective and preventive reporting channels, which ensures the investigation of acts of corruption, and investigation of complaints of retaliatory, and because the cultural perception of whistleblowers may also constitute a significant barrier to reporting international law documents confirm that this cultural connotations needs to be taken into account, when developing and implementing whistleblower protection legislation .
