نقل التكنولوجيا عن طريق عقد ترخيص براءة الاختراع

Résumé: يعد عقد الترخيص باستغلال براءة من أبرز العقود المتضمنة نقلا صريحا للتكنولوجيا من المرخص المورد إلى المتلقي المرخص له، حيث تسهم هذه الأخيرة متى قام عقدها صحيحا في تنمية الإقتصاديات الوطنية من خلال جلب المعارف والخبرات الجديدة. إلا أن هذه الأخيرة ظلت عمليا محتكرة من طرف دول ومؤسسات فاعلة تسعى على الدوام على إبقاء حصرية هذه المعارف لديها . جاءت هذه الدراسة لتبيان ماهية عقد ترخيص براءة الاختراع في المبحث الاول، أما المبحث الثاني فقد خصصناه لآثار عقد ترخيص براءة الاختراع كوسيلة من وسائل نقل التكنولوجيا. A patent licensing contract is one of the most prominent contracts with an explicit transfer of technology from the supplier licensee to the licensed recipient. Once properly held, the contract contributes to the development of national economies by bringing in new knowledge and expertise. In practice, however, the latter has been monopolized by States and by active institutions that have consistently sought to maintain their exclusivity. This study shows what the patent licence contract is in the first research. The second study devoted it to the effects of the patent licence contract as a means of technology transfer.
