الجوانب القانونية لعقد ترخيص براءة الإختراع

Résumé: يعتبر عقد الترخيص باستغلال براءة الاختراع أحد أهم الوسائل في العصر الحالي لنقل التكنولوجيا، إذ يساعد في الحصول على أهم الاختراعات واستغلالها بطريقة قانونية وعملية، حيث يوفر فرصة لصاحب الاختراع لإشهار سمعته وتطبيقه عملياً والحصول على المقابل المادي لذلك الاستغلال من ناحية، ويقدم لطالب الترخيص إمكانية الحصول على اختراعات مهمة والاستفادة من تطبيقها العملي من ناحية أخرى. ونظراً لأهمية هذا العقد من الناحية التنموية والقانونية، جاءت هذه الدراسة محاولة جادة لاستكشاف كنهه وجوانبه وآثاره لمحاولة تقديم فكرة جلية لمن يرومون التعاقد من خلاله أو دراسته، وذلك من خلال مبحثين، تناول المبحث الأول ماهيته عقد الترخيص بشكل عام، اين عولج مفهوم العقد وتكييفه القانوني ثم شروط إبرامه، أما في المبحث الثاني فقد تم البحث في آثار عقد الترخيص، حيث تم تناول إلتزامات أطراف عقد الترخيص، ثم لإنتهائه. One of the most important means of technology transfer in the current era is the patent licensing contract, which helps to obtain and exploit the most important inventions in a legal and practical manner. It provides an opportunity for the inventor to make his or her reputation known and applied in practice and to obtain the material equivalent of such exploitation, on the one hand, and offers the applicant the possibility to obtain important inventions and benefit from their practical application. In view of the developmental and legal importance of this contract, this study was a serious attempt to explore its character, aspects and implications to try to provide a clear idea for those who contract through it or study it. Through two researchers, the first researcher dealt with what a licence contract is, in general, where the concept of a contract, its legal adaptation, and the terms of its conclusion were addressed.
