إشكالية تطبيق أحكام المسؤولية الجنائية على جرائم الذكاء الاصطناعي

Résumé: أسفرت التكنولوجيا الحديثة والتي كانت نتاجاً للثورة الصناعية الرابعة عن إنجازات علمية بشرية لم يسبق لها مثيل كان من أهمها تطبيقات الذكاء الاصطناعي وكما ان لتلك التطبيقات العديد من النواحي الإيجابية إلا أنها أسفرت عن العديد من السلبيات التي كان من أهمها ارتكاب الجرائم المختلفة. وقد كان من الأهمية إلقاء الضوء على الحالة التي يرتكب فيها الذكاء الاصطناعي الجريمة بنفسه؛ هل يمكن إنزال أحكام المسؤولية الجنائية عليه. لذلك تم تناول هذه الدراسة من خلال تقسيم البحث إلى مبحثين المبحث الأول يدور حول ماهية الذكاء الاصطناعي؛ بينما يتناول المبحث الثاني حدود المسؤولية الجنائية عن جرائم الذكاء الاصطناعي. وكان من أهم نتائج البحث عدم وجود تشريع خاص ينظم أحكام المسئولية الجنائية. Modern technology, which was a product of the Fourth Industrial Revolution, resulted in unprecedented human scientific achievements, the most important of which were the applications of artificial intelligence, and while these applications had many positive aspects, they resulted in many negatives, the most important of which was the commission of various crimes. It was important to shed light on the case in which artificial intelligence commits the crime itself; can it be held criminally liable. Therefore, this study was addressed by dividing the research into two research topics, the first of which revolves around what artificial intelligence is, while the second deals with the limits of criminal liability for AI crimes. One of the most important findings of the research was the lack of special legislation regulating the provisions of criminal liability.
