Criminal Liability Arising From Artificial Intelligence Crimes

Résumé: This study addressed one of the most important legal issues arising from the use of artificial intelligence applications, related to the criminal liability of these intelligent entities when they commit crimes against persons. This study examined the existing jurisprudential debate on the attribution of criminal liability to these intelligent entities by identifying the extent of recognition of their legal personality, as well as identifying the parties of criminal liability and the penalties that Can be imposed on artificial intelligence entities, trying to présent and analyse the relevant legal texts on the extent to which artificial intelligence entities benefit from the grounds of permissibility and contraindications to criminal liability. تناولت هذه الدراسة أحد أهم الإشكاليات القانونية التي نجمت عن استخدام تطبيقات الذكاء الاصطناعي، والمتعلقة بالمسؤولية الجنائية لهذه الكيانات الذكية وذلك عند اقترافها للجرائم ضد الأشخاص، فلقد وقفت هذه الدراسة على الجدل الفقهي القائم حول إسناد المسؤولية الجزائية لهذه الكيانات الذكية وذلك من خلال الوقوف على مدى الاعتراف بالشخصية القانونية لها وكذا تحديد أطراف المسؤولية الجزائية والعقوبات التي يمكن تسليطها على كيانات الذكاء الاصطناعي، محاولين عرض وتحليل النصوص القانونية ذات الصلة عن مدى افادت كيانات الذكاء الاصطناعي بأسباب الإباحة وموانع المسؤولية الجنائية.
