التراضي في العقد الالكتروني في ظل التغيرات المستجدة

Résumé: ان التقدم الهائل لوسائل الاتصال كان له تاثير جوهري على الطريقة التي يتم بمقتضاها ابرام العقود فظهرت العقود الالكترونية التي من مميزاتها توفير الوقت والجهد لامكانية ابرامها دون الحضور المادي للمتعاقدين. يعتبر التراضي ركنا مهما في ابرام وتنفيد العقود، حيث يهدف البحث في خصوصية ركن التراضي في عقد التجارة الالكترونية الى البحث في مدى جوازية التعبير عن هذه الارادة بواسطة الايجاب والقبول بالطرق الالكترونية خاصة وان القانون الجزائري يخلو من احكام خاصة تنظم التراضي في العقود الالكترونية.
