الحكومة في ظل التعديل الدستوري لسنة 2020

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على الحكومة باعتبارها مؤسسة دستورية هامة في تحديد نوع النظام السياسي الذي انتهجه المؤسس الدستوري الجزائري في التعديل الدستوري لسنة 2020، إذ تتناول الدراسة تشكيل الحكومة بنوعيها وتبعيتها لرئيس الجمهورية من عدمها وعلاقتها بالبرلمان، والصلاحيات الممنوحة لها، بغرض الوصول إلى طبيعة النظام السياسي الذي سطره المؤسس الدستوري، إلا أنه من الصعب الفصل في طبيعة النظام السياسي على ضوء النظام القانوني للحكومة نظرا لعدم تقيد المؤسس الدستوري بخصائص النظام البرلماني كما هي بخصوص الحكومة التي يقودها رئيس الحكومة وأيضا مخالفته لبعض خصائص النظام الرئاسي بخصوص الحكومة التي يقودها الوزير الأول. This study aims to shed light on the government as an important constitutional institution in determining the type of political system that the Algerian constitutional founder pursued in the constitutional amendment for the year 2020, as the study deals with the formation of the government of both types and its subordination to the President of the Republic or not and its relationship with Parliament, and the powers granted to it, in order to reach the nature The political system written by the constitutional founder, however, it Is difficult to separate the nature of the political system in light of the legal system of government, given that the constitutional founder does not adhere to the characteristics of the parliamentary system as it Is with regard to the government led by the prime minister, and also his violation of some characteristics of the presidential system regarding the government led by the prime minister.
