تدابــــير الوقــاية من جريمة تبييض الأموال في الجــــزائر على ضوء تعديلات القانون 23-01

Résumé: تسعى الدراسة إلى تسليط الضوء على اهتمام المشرع الجزائري وتوجّهه الفعلي نحو تكريس الوقاية من جريمة تبييض الأموال، وإنفاذ ذلك من خلال مجموعة من التدابير التي نصّ عليها صراحة بموجب القانون رقم 23-01 المعدّل والمتمم للقانون 05-01 المتعلق بالوقاية من تبييض الأموال ومكافحة الإرهاب، بالموازاة مع إصداره لنصوص تنظيمية تتعلق بالهيئات المتخصصة في هذا المجال. توصلت الدراسة إلى تبني المشرع الجزائري بموجب التعديل 23-01 العديد من تدابير الوقاية، وإلى توسيع قائمة الخاضعين إلى مؤسسات غير مالية ومهن حرّة، والى انشاء هيئات متخصصة تتولى معالجة الاخطار بالشبهة وقياس المخاطر الناجمة عن هذه الجريمة بهدف استباق حدوثها، ودرء أثارها الوخيمة. The study seeks to shed light on the actual orientation of the Algerian legislator towards devoting the prevention against money laundering crimes, through a set of measures stipulated under Law No. 23-01 amending Law No. 05-01 related to prevention of money laundering. In parallel with regulatory texts related to specialized bodies in this field. The study concluded that the Algerian legislator adopted, according to Amendment 23-01, many preventive measures, beside expanding the list of subjects and established specialized bodies that deal with of suspicion and measure the risks arising from this crime in order to anticipate its occurrence, and prevent its dire effects.
