الاستدلال بالتلازم الشرطي في الدرس الأصولي ودفْع الاعتراضات الواردة عليه

Résumé: ملخص: يُعدّ الاستدلال بالتلازم الشرطي منهجا أصوليا مُحْكما يستهدي به المجتهد في استنباط الأحكام، ويُثبت به القواعد الأصولية تارة، ويُبطل به بعضها تارة أخرى، كما أنّه يُعدّ تارة دليلا ابتداء، وتارة أخرى يُستدلّ به توجيها لدليل آخر، كالكتاب والسنة وغيرهما. ثمّ إن هذا المصطلح "الاستدلال التلازم الشرطي"، إذا أُطلق فالمراد به القياس الاستثنائي، والقياس الاقتراني في شقّه الشرطي. أمّا ما اعترض به بعض الأصوليين عن الاستدلال بــ "التلازم الشرطي"، فلا يقوى أمام أدلّة القائلين بحجّيته. وعليه: فإنّه يُعدّ دليلا شرعيا عقليا؛ متى ما عُلم ثبوت التلازم، وعُلم ـــ أيضا ــ تحقّق الملزوم من نفي أو إثبات correlation” is not strong against the evidence of those who claim its authority. Abstract: Deduction by conditional concomitance is considered a solid and perspicuous approach.It is used by mujtahids in deducing rulings, sometimes establishing USUL rules, and invalidating some of them at other times.It is also considered an evidence in itself, and at other times it is inferred as a guidance to another evidence, such as the Holy Quran, the Sunnah, and others. Moreover, when the term "Deduction by conditional concomitance" is used genaraly,It is to interchangeably mean the controversal analogy and the normal analogy in its conditioned part.
