لجان الحقيقة كآلية للعدالة الانتقالية

Résumé: تهدف العدالة الانتقالية للتحقيق في انتهاكات حقوق الإنسان والمساءلة عنها وتعويض الضحايا وإصلاح المؤسسات وتحقيق المصالحة الوطنية، من خلال نهج مُتكامل يجمع بين اليات قضائية وغير قضائية، ونظرا لما يميز المجتمعات الانتقالية، فان تطبيق المساءلة عن طريق المحاكمات لوحدها أو من خلال اعتماد لجان الحقيقة أو كلاهما معا، يعود لخصوصية كل مجتمع والتوازنات السياسية في الدولة. تسعى لجان الحقيقة إلى التحقيق في الانتهاكات ومعرفة أسبابها ومرتكبيها، والتوصية من خلال تقاريرها النهائية بما يلزم لمنع تجدد الانتهاكات وصولا لتحقيق المصالحة الوطنية، لذلك فهي تعد أبرز اليات العدالة الانتقالية. Transitional justice aims to investigate human rights violations and accountability for them, compensate victims, reform institutions and achieve national reconciliation, through an integrated approach that combines judicial and non-judicial mechanisms, and given what distinguishes transitional societies, the application of accountability through trials alone or through the adoption of truth commissions or both Together, it is due to the privacy of each society and the political balances in the country. Truth commissions seek to investigate violations, learn their causes and perpetrators, and recommend through their final reports what is necessary to prevent the recurrence of violations in order to achieve national reconciliation, and therefore they are the most prominent transitional justice mechanisms.
