المحكمة الجنائية الخاصة لسيراليون كآلية لتجسيد مفهوم العدالة الانتقالية

Résumé: الملخص: يعتبر مفهوم العدالة الانتقالية من المفاهيم الحديثة التي ظهرت مع بروز الصراعات في المجتمعات التي تعرف انتقالا نحو الديمقراطية ليتم ربط هذا المفهوم بالقضايا المتعلقة بالانتهاكات والاعتداءات الخطيرة للقانون الدولي الإنساني و حقوق الإنسان، حيث تسعى العدالة الانتقالية إلى كشف الحقيقة و تعويض ضحايا الانتهاكات الجسيمة للقانون الدولي، إصلاح المؤسسات، وتعزيز المصالحة وتجسيد فكرة دولة القانون. وفي هذا الإطار يعتبر نموذج سيراليون للعدالة الانتقالية الأكثر شيوعا في القارة الإفريقية، ولعل أهم ما يميز عدالة ما بعد سيراليون ، جود العدالة الجنائية الدولية كآلية موازية، ممثلة في المحكمة الخاصة لسيراليون التي ساهمت من خلال مجموعة من الآليات في تكريس مفهوم العدالة الانتقالية. Abstract: The concept of transitional justice is a modern concept that has emerged with the emergence of conflicts in societies known as a transition to democracy to be linked to issues related to serious violations of international humanitarian law and human rights, where transitional justice seeks to uncover the truth and compensate the victims of grave violations of international law, and reforming institutions, Embody the idea of the state of law. Sierra Leone’s model of transitional justice is the most common in the African continent. Perhaps what distinguishes post- Sierra Leone justice is the existence of international criminal justice as a parallel mechanism, represented by the Special Court for Sierra Leone, which has contributed through a set of mechanisms to enshrine the concept of transitional justice.
