تدابير العفو كآلية للعدالة الانتقالية Amnesty Measures As A Transitional Justice Mechanism

Résumé: العدالة الانتقالية تُزاوج بين آليات قضائية وغير قضائية سعيا لتحقيق أهداف أبرزها تحقيق المصالحة وإرساء السلم وسيادة القانون، كل ذلك وفق ما تقتضيه مبادئ القانون الدولي، فالعفو يعتبر من ابرز آليات تحقيق المصالحة الوطنية. فان كانت العدالة الانتقالية تُعنى بالتحقيق والمساءلة عن الانتهاكات الجسيمة لحقوق الإنسان، إلا أن تدابير العفو قد تحول دون ذلك وهو ما يتناقض مع التزامات الدولة في مجال إقامة العدل، وعليه قد تعتبر تدابير العفو مخالفة للقانون الدولي في حال شمولها للانتهاكات الجسيمة لحقوق الإنسان. Transitional justice intermarries judicial and non-judicial mechanisms in pursuit of goals, most notably the achievement of reconciliation, peace and the rule of law, all in accordance with the requirements of international law. Amnesty measures is one of the most prominent mechanisms for achieving national reconciliation. If transitional justice is concerned with investigating and holding accountable for grave violations of human rights, pardon measures may prevent this, which is inconsistent with the state's obligations to administer justice, and therefore pardon measures may be considered contrary to international law if they include amnesty on grave violations of human rights.
