أحكام جريمة هتك عرض القاصر دراسة مقارنة بين قانون العقوبات العراقي وبعض التشريعات الجزائية العربية The Provisions Of The Crime Of Sexual Molestation Of A Minor A Comparative Study Between The Iraqi Penal Code And Some Arab Penal Legislation

Résumé: يتناول هذا البحث أحكام جريمة هتك عرض القاصر في قانون العقوبات العراقي. الغرض منه هو التعرّف على مدى استيعاب المادتين (396، 397) من قانون العقوبات لأحكام هتك عرض القاصر، وفيما إذا كانتا تعانيان ثغرات تشريعية من عدمه، وهل يمكن إثراء القانون بالنصوص قانونية. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي، المقارن، والنقدي. واختتم البحث بنتائج وهي: أن المشرع العراقي، ومن خلال المادتين المذكورتين أعلاه حاول تغطية جميع الأحكام المتعلقة بعنوان هذه الدراسة، وكان موفقاً إلى حدٍّ بعيد، ورغم ذلك شابت المادتان ثغرات تشريعية طفيفة، ومن أجل سد تلك الثغرات اقترحنا عليه نصوص قانونية بديلة. This research deals with the provisions of the crime of sexual molestation of a minor in the Iraqi Penal Code. Its purpose is to identify the extent to which articles (396, 397) out of the Penal Code include the provisions of the aforementioned crime, whether they suffer from legislative loopholes or not, and can the law be enriched with legal texts? In order to achieve this, the researcher used the analytical, comparative, and critical inductive approach. The research concluded with the following results: The Iraqi legislator, through the two articles mentioned above, tried to cover all the provisions related to the title of this study, and was largely successful, despite that, the two articles were marred by legislative loopholes. In order to fill those loopholes, we proposed alternative legal texts.
