أحكام رضاعة الصغير دراسة مقارنة بين القانون العراقي و(الشريعة الإسلامية، التشريعات العربية) The Provisions Of Breastfeeding Baby A Comparative Study Between Iraqi Law And (islamic Law & Arab Legislation)

Résumé: يتناول هذا البحث أحكام رضاعة الصغير في قانون الأحوال الشخصية العراقي مقارنة بالشريعة الإسلامية والتشريعات العربية. والغرض منه هو التعرّف على مدى استيعاب القانون العراقي لهذه الأحكام واقتراح نصوص بديلة في حالة وجود الثغرات القانونية. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي والمقارن. واختتم البحث بنتائج وهي: أن القانون العراقي يعتريه فجوة تشريعية كبيرة فيما يخص أحكام رضاعة الصغير، حيث أن النصوص القانونية الحالية غير قادرة على تغطيتها، ولهذا تم اقتراح مواد قانونية في خاتمة البحث. Abstract: This research deals with the provisions of breastfeeding baby in Iraqi personal status law comparing to Islamic law and Arab legislation. Its purpose is to identify the extent to which the Iraqi law includes these provisions and suggesting alternative texts in case there are legal loopholes. In order to achieve this, the researcher used the inductive analytical and comparative method. The research was concluded with results, which are: The Iraqi law has a major legislative loophole with regard to the provisions of breastfeeding’s baby, as the current legal texts are unable to cover them. Therefore, legal articles were proposed in the conclusion of the research.
