المركز القانوني للحيوان في القانون المدني Legal Status Of Animal In Civil Law
Résumé: إن الهدف من البحث هو إخراج الحيوان من دائرة الأشياء والاعترافُ بأنه كائن حي ذو أحاسيس. أهم النتائج المتوصل إليها: أن القانون لا يفرّق بين الشيء والحيوان، وأن الحيوان ككائن حي يحظى بحماية قانونية في التشريعات الوطنية والغربية. وعليه لا بد من إعادة النظر في مركز الحيوان في القانون المدني، ووضع نظام قانوني خاص يخضع له. The aim of the research is to remove the animal from the circle of things and to recognize that it is a living creature with feelings. The most important resultsreached are that the civil law does not differentiate between a thing and a animal, and the animal enjoys legal protection in various national and occidental legislations. Accordingly, it is necessary to reconsider the status of animal in the civil law, and to establish a special legal system to which it is subject.
