الحائط المشترك والفاصل في القانون المدني الجزائري والفقه الإسلامي

Résumé: الملخص: تناولنا في هذا البحث كل من أحكام الحائط المشترك والذي يعد ملكا لجميع الجيران وبينا الأحكام المتعلقة به سواء في القانون المدني الجزائري أو الفقه الإسلامي ، كم تناولنا أحكام الحائط الفاصل بين الملكين والذي يعد ملكا لأحد الجيران فقط وبينا أحكامه في القانون المدني والفقه الإسلامي ، وقد تم التركيز في هذا البحث على أثر الفقه الإسلامي في القانون المدني الجزائري في موضوع الحائط المشترك والفاصل . Common wall and separation in the Algerian civil law and Islamic jurisprudence In this paper, we discussed the provisions of the joint wall, which is the property of all neighbors, and the relevant provisions, whether in the Algerian civil law or Islamic jurisprudence, how we dealt with the provisions of the separation wall between the two kings, which is the property of one of the neighbors only and we set out its provisions in civil law and Islamic jurisprudence. The focus of this research is on the impact of Islamic jurisprudence in the Algerian civil law on the subject of common wall and separation.
