جریمة السب بین الشریعة والقانون دراســــة مـقـــــارنــــــة
Résumé: تناول هذا البحث موضوع الجرائم والعقوبات بصفة عامة، واقتصر على دراسة لسب، إذا فالسب من الجرائم الماسة بشرف واعتبار الأشخاص، فهي إیذاء محرم وقول معاقب علیه)شرعا وقانونا(، لما فیه من انحطاط لكرامة الشخص واعتباره، مثل جریمة الإهانة والتشهیر التي تدخل ضمن جرائم الشرف والاعتبار، وللسب صور متعددة، بالإض لأحكام في الشریعة فقد یكون مباح أو مكروه أو محرم، وأركان الجریمة في القانون، لذا ن لعقوبة تختلف بحسب ما یقوله الساب، فقد تكون عقوبة حدیة لمن سب ذات االله تعالى أو صلى االله علیه وسلم، فیترتب علیها الكفر، وكذلك تنتج عنها الردة، وقد تكون عقوبة تعزیری ن السب جریمة معاقب علیها نجده مباح في بعض الحالات، لذا فقد تضمن البحث ثلاث صل تمهیدي یتكلم عن الجریمة والعقوبة بشكل عام، والفصل الأول یتحدث عن ماهیة والفصل الثاني الحالات التي یباح فیها السب وعقوبته)شرعا وقانونا(.
