الالتزام بضمان السلامة الخاصة في المواد الغذائية الموجهة للإستهلاك

Résumé: ملخص: لا يزال موضوع الالتزام بضمان السلامة في عقود الاستهلاك يطرح نقاشات واشكالات عدّة خصوصا تقريره إلى جانب الالتزامات المقرّرة في القواعد العامة التي كان لها وقع كبير توسّعت من خلاله دائرة أنواع المنتوجات التي تهدّد صحة وسلامة المستهلك خصوصا الغذائية منها. فتقرير الالتزام بضمان سلامة خاصة بالمواد الغذائية كان امتدادا لتقريره كالتزام عام في عقود الاستهلاك ونتيجة لعجز هذه الأخيرة في حماية المستهلك من مخاطر الأغذية المغشوشة والفاسدة، كان ضروريا تسليط الضوء عن تأصيل الالتزام بضمان السّلامة الخاصة في المواد الغذائية وتقريره التشريعي كالتزام مع إبراز خصوصية مظاهره في مجال المواد الغذائية. Abstract: The subject of obligation to ensure safety in consumer contracts still raises many dibates and problems, especially his repport in addition to the obligations stipulated in the general rules, which had a great impact, through which the range of types of products that threaten the health and safety of the consumer, especialy food products, expanded. The report on the commitment to ensure the specific safety of foodstuffs was an extention of its report as a general obligation in consumer contracts and a result of the letter’s inability to protect the consumer from the dangers of adulterated and spoiled food. Therefore, it was necessary to shed light on the consolidation of commitment to ensure the specific safety of food products and its legislative report as a obligation while apparited in the feild of food stuffs.
