إصلاح المرفق العام في الجزائر The Reform Of The Public Facility In Algeria

Résumé: الملخص: يتم تبرير إنشاء المرفق العام من حيث الأصل بتلبية الحاجات العمومية للمواطنين ، و هذه الحاجات العمومية تتغير باستمرار ، فهي تخضع لمجموعة من الظروف والمتغيرات المتعددة والمتنوعة ، وهو ما يجعل قواعد عمل وسير المرافق العمومية تتغير كذلك لكي تستطيع التأقلم مع هذه الظروف والمستجدات ، وذلك إعمالا لمبدأ التكيّف الذي يعتبر من المبادئ التقليدية للمرفق العام ، إلا أن المشرع الجزائري انتهج سياسة اصلاح متعددة الجوانب تم اختتامها بتطوير مبادئ المرفق العمومي الى مبدأين هامين هما : مبدأ جودة الخدمات التي يؤديها المرفق العام ومبدأ نجاعة المرفق العمومي ككل أي فعاليته لتأدية الخدمة العمومية ، فسياسة الاصلاح تتميز بالتنوع فهو يعني الاصلاح الهيكلي للمرفق العمومي ،كما يتضمن الاصلاح الموضوعي أي تحسين وعصرنة مفهوم الخدمة العمومية ، ولأجل ذلك يجب أن تتضمن سياسة الإصلاح تكريس هيكل خاص يسهر على ضمان ورقابة ذلك. Abstract : The establishment of a public facility is justified ,in principle, by meeting the public needs of citizens; These general needs are constantly changing, and they are subject to a set of multiple and varied circumstances and variables. However, the Algerian legislator adopted a multi reform policies, which was concluded by developing the principles of the public utility into two important principles: The principle of the quality of services performed by the public utility and the principle of the efficiency of the public utility as a whole, that is, its effectiveness in performing the public service, The reform policy is characterized by diversity, as it means the structural reform of the public utility; Substantive reform also includes any improvement and modernization of the concept of public service. For this purpose, the reform policy must include a special structure that ensures controlling.
