أثر واجب تحفظ الموظف العام على ممارسة الحقّ النّقابي

Résumé: يعتبر الموظف العام محور التخطيط والتنفيذ للسياسة العامة للدولة فهو يقوم بدور فعال من خلال إدارة المرافق العمومية وتقديم الخدمات للمنتفعين بها لهذا عملت مختلف قوانين الوظيفة العمومية على وضع الواجبات الوظيفية من أجل ضبط مهام هذا الموظف ،وفي نفس الوقت تمكينه من حقوقه ويعتبر واجب التحفظ من اهم الواجبات الوظيفية التي تقع على عاتق الموظف باعتباره يؤطر بعض الحقوق مثل حق ممارسة العمل النقابي ،وبالتالي له تأثير على النشاط النقابي ولعل أن هذا يرجع إلى عاملين أساسيين هو أن الموظف العمومي يمثل الدولة وفي نفس الوقت نجد أن واجب التحفظ من الواجبات غير المحددة والمعرفة فهو مرتبط بالواجبات الأخرى والتي قد تفرضها طبيعة الوظيفة العمومية بحد ذاتها . The public servant is the focus of planning and implementing the public policy of the State. He plays an active role through the management of public utilities and the provision of services to its beneficiaries. Therefore, the various laws of the public servant have worked to establish the functional duties in order to control the functions of this employee and, at the same time, to enable him or her to exercise his or her rights and to consider the duty of reservation as one of the most important functional duties of an employee as framing certain rights such as the right to engage in trade union work, Thus, it has an impact on trade union activity. This may be due to two main factors: the public official represents the State. At the same time, the duty of reservation is an undefined and knowledgeable obligation, which is linked to other duties which may be imposed by the nature of the public office itself.
