بيع أموال القاصر العقارية بالمزاد لاستحالة القسمة العينة.

Résumé: يعتبر التشريع الخاص بالعلاقات اﻷسرية (قانون اﻷسرة) المنظم ﻷحكام القاصر ومن يدخل في حكمه، سواء تعلق اﻷمر بالأهلية ﺃو علاقاتهم بمن يتولى رعاية شؤونهم الشخصية والمالية، إذ بعد فصله في ﺃحكام الأهلية والتفريق بين القاصر، " عديم الأهلية، والمميز" وبين علاقته مع وليه الشرعي الذي يتولى رعايته في" النفس والمال ". من صور الحماية التي جاء بها المشرع الجزائري، تقيد النائب الشرعي لسلطاته بمجموعة من الإجراءات في حال تصرفه في مال القاصر التي تتسم بالأهمية والتأثير الكبير على ثروة القاصر المالية، المقرونة بشرط اﻹذن من القاضي لحماية المال المملوك للقاصر من تصرف النائب الشرعي ذلك ﻹعطاء نوع من الضمان، سواء تعلق اﻷمر بالبيع ﺃو القسمة وغيرها من التصرفات الخطيرة على مال القاصر. Family relations legislation governs the provisions of the minor and those who come into his reign, whether the matter is related to eligibility or their relationship with someone who takes care of their personal and financial affairs, because after his decision in the eligibility provisions and the distinction between th minor is considered incompetent, andcompetentand his relationship with his legal guardian who takes care of him and his money. Among the forms of protection provided by the Algerian legislator, is to limit the power of the legal guardian by a set of Procedures in case he disposes of the minor's money which is of great importance and has a great influence on the financial wealth of the minor, in addition to the condition of authorization of the judge to protect the minor's money against the behaviour of legal guardian this gives a sort of guarantee, whether it's related to selling or splitting and other dangerous behaviour on the miner's money.
