عناصر مشروعية القرار الإداري بين التقييد والتقدير

Résumé: إن النصوص القانونية قد تمنح الإدارة الحرية في مباشرة بعض اختصاصاتها . و في المقابل ، فإن النصوص القانونية قد تلزم الإدارة بالتصرف على نحو معين . ففي الحالة الأولى نكون إزاء ما يطلق عليه بالسلطة التقديرية ،و في الحالة الثانية ، نكون إزاء ما يطلق عليه بالإختصاص المقيد . غير أن تمتع الإدارة بهذه الحرية فيما يصدر عنها من تصرفات ، لا يعني بالضرورة تجاهل مبدأ المشروعية ، و لاحتى الخروج عليه ، فالسلطة التقديرية للإدارة يجب أن تمارس في حدود مبدأ المشروعية It’s possible , that the administration hase some thing of liberty of action ,and the power of the choosing its behaviour in front of this fonction . In thefirste case , we are in front of what they called the discrétionnary power of the adminstration . where as in the second case , we are in front of the tie-upcompétence . But the administration ignore the principal of the legality in front of choosing this acts . So , the discrétionnary power of the administration have to be exercised in the limit of the legale principale .
