تسليم المتهمين بارتكاب جرائم دولية وحكمه في الفقه الاسلامي Extradition Of Accused Of International Crimes And Its Ruling In Islamic Jurisprudence

Résumé: تتناول الدراسة موضوعاً مهماً ألا وهو موضوع تسليم المهتمين بارتكاب جرائم دولية، وقد بينا في هذه الدراسة مفهوم تسليم المتهمين ، ثم وضحنا أسس تسليم المتهمين في الإسلام ، والغاية الشرعية منه، وختمت الدراسة ببيان الحكم الشرعي لتسليم المتهمين في الإسلام ، وخلصت الدراسة إلى أن نظام التسليم في الإسلام يهدف لتحقيق العدالة والقضاء على الظاهرة الإجرامية وهذه أهداف يشترك فيها مع النظم الوضعية, كما أن الحكم الشرعي للتسليم يتميز بنوع من الثبات فلا يجوز في حالات وهناك حالات أخرى يمكن النظر فيها ودراستها. Abstract: The study deals with an important topic, which is the issue of extradition of those interested in committing international crimes, and we explained in this study the concept of extradition of defendants, then we clarified the foundations of extradition of defendants in Islam, and the legitimate purpose of it. In Islam, it aims to achieve justice and eliminate the criminal phenomenon, and these goals are shared with man-made systems, and the legal ruling of submission is characterized by a kind of stability, so it is not permissible in cases and there are other cases that can be considered and studied
