منح الامتياز على الأراضي التابعة للأملاك الخاصة للدولة والموجهة لإنجاز مشاريع استثمارية في إطار أحكام الأمر رقم 08-04 المعدل والمتمم

Résumé: يعتبر الامتياز هو نمط استغلال الأراضي التابعة للأملاك الخاصة للدولة والموجهة لانجاز مشاريع استثمارية في إطار أحكام الأمر رقم 08-04 المعدل والمتمم، ونصوصه التنظيمية، حيث يمنح عقد الامتياز بالتراضي مقابل دفع إتاوة إيجارية سنوية، لمدة أدناها 33 سنة وأقصاها 99 سنة وهي قابلة للتعديل كل 11 سنة بموجب قوانين المالية. يخضع عقد الامتياز لنظام الامتياز الغير قابل للتحويل إلى تنازل، حيث يستفيد المستثمر من امتيازات وتخفيضات مالية على مبلغ الإتاوة، وإعفاءات من مصاريف إعداد وتسليم عقود الامتياز تقررها قوانين المالية، وهذا من أجل تحسين مناخ الاستثمار في الجزائر، وتحقيق التنمية الاقتصادية. The concession is the land-use pattern of the state’s private property and is intended for the completion of investment projects within the provisions of order No 08-04 amended and supplemented , and its regulatory texts , whereby the concession contract is granted by mutual agreement for the payment of an annual rental fee for a minimum of 33 years and a maximum of 99 years under the finance laws The concession contract is subject to a concessionary non transferable concession system wherby the investor benefits from financil concessions and reduction on the amount of royalty and exemptions from the expenses of preparing and delivering concession contracts determined by the finance laws , in order to improve the investment climate in algeria and achieve economic development
