منازعات عقد الإمتياز لإستغلال العقار الصناعي Concession Contracts Disputes For The Exploitation Of Industrial Real Estate

Résumé: قد ينجر عن إبرام عقد الإمتياز وتنفيذه منازعات تنشأ بين صاحب الإمتياز والهيئة المانحة للإمتياز، يجعل اللجوء إلى القضاء أمرا مفروضا للفصل في هذه المنازعات. حيث تضمنت المادة 12 من الأمر رقم 08 / 04 المحدد لشروط وكيفيات منح الإمتياز على الأراضي التابعة للأملاك الخاصة للدولة والموجهة لإنجاز مشاريع استثمارية أنه يترتب على كل إخلال من المستفيد من الإمتياز للتشريع الساري المفعول وللإلتزامات التي يتضمنها دفتر الأعباء ،إتخاذ الإجراءات من اجل اسقاط حق الإمتياز لدى الجهات القضائية المختصة وبمبادرة من مدير أملاك الدولة المختص . و يؤول الاختصاص في الفصل في هاته المنازعات للقضاء الاداري ،لكن القضاء ليس الحل الوحيد بل هناك حلول أخرى بديلة للنظر فصل المنازعات الادارية و المتمثلة في امكانية اللجوء الى التحكيم التجاري الدولي و التسوية الودية . Disputes arising between the franchisee and the concession donor may result in the conclusion and implementation of the concession contract, which makes the use of the court an imposition for adjudication of such disputes. The jurisdiction in the adjudication of these disputes is competent to the administrative judiciary, but the judiciary is not the only solution, but there are other alternative solutions to consider the separation of administrative disputes, which is the possibility of resorting to international commercial arbitration and amicable settlement, as stipulated in Order No. 08/04.
