Résumé: تعتبر دراسة الحرية الدينية ذات أهمية كبيرة بين الدول خاصة تلك التي يهيمن فيها الإسلام و في تلك التي تتواجد فيها الكنيسة الكاثوليكية لذا نجد اهتمام المواثيق و القوانين و الدولية و الداخلية بهذا الحق. و لم يقتصر التكريس الدولي للحق في حرية المعتقد وممارسة الشعائر الدينية على الصكوك و القوانين الدولية بل تعزز تكريسه القانوني في النصوص القانونية الإقليمية، و في التشريعات الداخلية من خلال الدساتير و القوانين و التنظيمات، و لان الدستور هو اسمى القوانين اخترنا دراسة اقرار و تكريس الدستور الجزائري لحرية المعتقد و ممارسة الشعائر الدينية و كيف ضبط ممارستها مع توفير الضمانات الموازية لهذه الممارسة و ذلك بدءا من دستور 1963 مرورا بالتعديلات الدستورية المتعاقبة وصولا لأخر دستور مع التبيين في البداية للمفاهيم الاساسية المتناولة في هذا البحث. The study of religious freedom is of great importance among countries, especially those with a Muslim majority and those in which the Catholic Church is present, hence this right has been given great attention by international and domestic schemes and laws. International interest in the right to freedom of belief and the practice of religious rites was not limited to global instruments, but was reinforced in regional legal texts of internal legislation in all constitutions, laws and regulations, It is well known that the Constitution is the supreme law, We have chosen to study the adoption of the Algerian constitution for freedom of belief and the practice of religious rites and how to control their practice while providing parallel guarantees for this practice, starting from the 1963 constitution through successive constitutional amendments to the last, With an explanation at the beginning of the basic concepts addressed in this research.
