الحماية القانونية للعمل النقابي

Résumé: ملخص: أقرت النصوص الدستورية في الجزائر الحق في العمل النقابي ونظمته بقواعد تشريعية ضمن القانون 90/14، وزيادة على منح المنظمة النقابية تسهيلات تمكنها من تمثيل العمال والدفاع عن حقوقهم الإجتماعية والمهنية نهضت قواعد التشريع الجزائري بحماية العمل النقابي على المستوى الإداري والجزائي. يهدف هذا الموضوع إلى تبيان قواعد حماية العمل النقابي التي كرستها النصوص الدولية والدستورية والتشريعية سواء تلك التي توفر الحماية للعمل النقابي ذاته أو تلك التي توفر الحماية للمنظمة النقابية كشخص معنوي أو كانت موجهة لحماية النقابي كشخص طبيعي، وفي كل الأحوال تكرس هذه القواعد الحمائية عقوبات جزائية للمخالفين. الكلمات المفتاحية: العمل النقابي؛ الحقوق؛ الحماية؛ التمثيل، الجزاء. Abstract: The constitutional texts in Algeria recognized the right to union work and organized it by legislative rules within Law 90/14, and in addition to granting the union organization facilities to enable it to represent workers and defend their social and professional rights, the rules of Algerian legislation rose to protect union work at the administrative and penal levels. This topic aims to clarify the rules for the protection of trade union work enshrined in international, constitutional and legislative texts, whether those that provide protection for union work itself or those that provide protection to the trade union organization as a legal person or were directed to protect the union as a natural person, and in all cases these protective rules devote penal sanctions to violators.
