المبادئ العامة المتعلقة بممارسة الحق النقابي وفقاً للقانون الجديد رقم 23/02

Résumé: يتأثر العمل النقابي وفقاً للقوانين المنظمة لممارسة الحق النقابي، بالإضافة إلى طبيعة عمل واختصاص المنظمة النقابية والهيئات القيادية التي تترأسها، ونظراً للتراجع الكبير للعمل النقابي في الجزائر بسبب تفتيت النقابات وعدم توزعها على مختلف المهن وكثرتها في مجالات دون الأخرى؛ لم تطرأ تعديلات وإضافات على القوانين المنظمة للحق النقابي لمدة كبيرة، إلى أن جاء القانون الجديد رقم 23-02 المتعلق بممارسة الحق النقابي، الذي تتمثل أهميته في اشتماله على العديد من الإضافات الجديدة انطلاقاً من استقلالية المنظمات النقابية وإجراءات تأسيس النقابات والفدراليات والكنفدراليات والنسب التمثيلية فيها، مروراً إلى إجراءات تنظيم سيرها ونظام عملها الداخلي، وإشكاليات وأسباب تعليق عملها وحلها، وصولاً إلى الحماية المادية والمعنوية للعمال الأجراء والمتعاقدين والموظفين العموميين، والحماية الجزائية لممارسة الحرية والحق النقابية، وبالتالي لتبرز معه أهداف الدراسة المتمثلة في التعديلات الجوهرية التي جاء بها القانون الجديد في ظل الحاجة الماسة لتنظيم العمل النقابي، ولغايات إبراز أهمية وجود نظام عام يسير المنظمات النقابية وينظم عملها وإجراءات تسيرها وانتشارها في مختلف المجالات. Trade union work is affected according to the laws regulating the exercise of the trade union right, in addition to the nature of the work and competence of the trade union organization and the leadership bodies it presides over, and given the significant decline in trade union work in Algeria due to the fragmentation of trade unions and their non-distribution to various professions and their abundance in fields to the exclusion of others; There were no amendments and additions to the laws regulating the trade union right for a long time, until the new Law No. 23-02 related to the exertion of the trade union right, which included many new additions starting from the independence of trade union organizations, the procedures for establishing trade unions, federations, and confederations, and the representative ratios in them, passing through to procedures Organizing its functioning and internal work system, problems and reasons for suspending its work and resolving it, leading to material and moral protection for salaried workers, contractors and public employees, and penal protection for the exertion of freedom and the right to trade union, Thus, to highlight the objectives of the study represented in the fundamental amendments brought by the new law in light of the urgent need to organize trade union work, and for the purposes of highlighting the importance of the existence of a general system that facilitates trade union organizations and regulates their work and procedures for their management and spread in various fields.
