الحماية القضائية للحق النقابي في التشريع الجزائري Judicial Protection Of The Right To Trade Unions In Algerian Legislation

Résumé: كفلت الصكوك الدولية حماية العمل النقابي واعتبرته من أهم الحقوق الاقتصادية والاجتماعية التي نالت اهتمام المجموعة الدولية في أواخر القرن الماضي، ومن هذه الصكوك الدولية نجد منظمة العمل الدولية، وكذا اتفاقية 48 المتعلقة بالحرية النقابية، وأوصت به دول الاطراف من أجل ضمان هذه الحماية في تشريعاتها الداخلية، وهو الدور الذي جسده قانون 23-02، المتعلق بحرية العمل النقابي. نظرا للنقائص والعراقيل التي تطبع الحماية التشريعية، خاصة من الجانب العملي، لذلك اثيرت فكرة الحماية القضائية لهذا لحق. تهدف هذه الدراسة لتبيان مختلف الضمانات القضائية والاحكام الاجرائية التي قررها المشرع في القانون 23-02 لتيسير ممارسة الحق النقابي وضمان عدم التعدي عليه، وكذا التعرف على الحدود التي وضعت لهذا الحق حتى لا تتجاوزها السلطة الادارية. International instruments have guaranteed the protection of trade union rights, considering them among the most important economic and social rights that gained international attention in the late last century. These international instruments include the International Labour Organization and Convention 48 on Freedom of Association, which recommended member states ensure such protection in their domestic legislation - a role embodied in Law 23-02 on trade union freedom. Due to practical deficiencies and obstacles in legislative protection, the concept of judicial protection for this right was raised. This study aims to demonstrate the various judicial guarantees and procedural provisions established by Law 23-02 to facilitate the exercise of trade union rights and ensure their protection from infringement. It also examines the limitations placed on this right to prevent administrative authority overreach.
