الامر الجزائي الية مستحدثة للإدانة في مادة الجنح دون محاكمة في التشريع الجزائري

Résumé: كرس المشرع الجزائري نظام الامر الجزائي بموجب تعديل قانون الاجراءات الجزائية لسنة 2015، وهو إِجْرِاء جَوازِي للنيابة العامة، تُحِيلْ بموجبه ملف الدعوى دون تحقيق الى القاضي، الذي يفصل فيه مباشرة ودون محاكمة بحكم جزائي يتضمن البراءة او الغرامة فقط، وقابل لِلاِعْتِراض عليه قبل تنفيذه. وتسعى هذه الدراسة؛ الى تحديد ماهية وأحكام نظام الامر الجزائي في التشريع الجزائري، ومدى فعاليته في إِنْهَاءَ الخصومة الجزائية دون محاكمة، ويُعْتبر نظام الامر الجزائي من الاجراءات البديلة المُوجزة في المتابعات الجزائية، التي تُحَقِق سرعة الفصل في القضايا الجُنْحيّة البسيطة، وتَيْسِير اجراءات المحاكمة فيها وتَبْسِيطِها، وتَخفيف العِبْء عن كاهِلِ القضاء. The Algerian legislature enshrined the penal order system according to the amendment of the Code of Criminal Procedure for the year 2015, which is a permissible procedure for the Public Prosecution, whereby the case file is transferred without investigation to the judge, who decides on it directly without trial with a criminal ruling that includes acquittal or just a fine, besides it is subjected to objection before its implementation. This study seeks to determine the nature and provisions of the penal order system in Algerian legislation, plus the extent of its effectiveness in ending criminal litigation.Morover, This penal order System is a brief alternative procedures in criminal proceedings, which expedites the resolution of simple migration crimes, facilitates and simplifies trial measures, and relieves the judiciary of the burden of elimination.
