الحماية القضائية لمستهلك التأمين في التشريع الجزائري Judicial Protection Of Insurance Consumer In Algerian Legislation

Résumé: يحتل موضوع الحماية القضائية لمستهلك التأمين ، مكانة هامة ضمن موضوعات الحماية القانونية للمستهلك، والتي أحاطها المشرع الجزائري بنظام قانوني خاص، حيث جعل في يد القاضي جملة من السلطات التي تمكنه من التدخل لتغيير مجرى العقد، بما يحفظ حقوق المستهلك، وفي هذه الورقة البحثية سنسلط الضوء على هذه السلطات ومدى نجاعتها في توفير الحماية اللازمة والكافية لمستهلك التأمين، وذلك من خلال بيان سلطة القاضي في إبطال الشروط التعسفية الورادة في عقد التأمين، وكذا سلطة القاضي في تفسير عقد التأمين، وأخيرا سلطة القاضي في إثبات عقد التأمين The issue of judicial protection for the insurance consumer occupies an important place among the topics of legal protection for the consumer, which the algerian legislature has surrounded with a special legal system, as it has made in the hands of the judge a set of powers that enable, as it has enabled the judge a set of powers that enable him to intervene to change the course of the contract , with which he preserves the rights of the consumer, and in this research paper, we will shed light on these authorities and their effectiveness in providing the necessary and adequate protection to the insurance consumer, by stating the judge’s authority to annul the arbitrary conditions contained in the insurance contract, and also the judge’s authority to interpret the insurance contract, finally the judge’s authority to prove the insurance contract.
