قاعدة الإستثمار الأجنبي 51-49 في الجزائر: بين إلزامية التبنّي و المطالبة بالتخلّي

Résumé: اتّخذت الجزائر من خلال قاعدة 51-49 % التي جاء بها قانون المالية التكميلي لسنة 2009 موقفا حذرا من الإستثمار الأجنبي ،إذ اعتبرها بعض المستثمرين و خاصة الأجانب أنّها تعيق تدفّقه إلى الجزائر، غير أنّ الدولة تعتبره أمرا لا نقاش فيه و يتعلّق بالسيادة الوطنية. سنحاول في هذه الورقة استعراض مختلف المواقف من تطبيق قاعدة 51-49 و التي تنقسم إلى ثلاث: هناك من يرفضها تماما و يدعوا للانفتاح التام على الاستثمارات الأجنبية، من يؤيّدها تماما باعتبارها تحفظ سيادة الدولة و تعزّز من حضورها الاقتصادي في اقتصاد هش مثل اقتصاد الجزائر، و آخرون لديهم موقف وسطي ينادون بتحديد القطاعات و المشاريع التي تخضع لهذه القاعدة بُغية تشجيع الإستثمار الأجنبي. Algeria has taken a cautious stance on foreign investment through the 51-49 % rule .Some investors.Some investors,especially foreigners, considered it to be a hindrance to its flow to Algeria. In this paper we will attempt to review the attitudes of applying the 51-49’s Rule which are divided into three :There are those who reject it in detail and call for full openness to foreign investments,There are those who fully support and see it as a guarantee to preserve the sovereignty of the state and strengthen its economic presence in a fragile economy such as the Algerian economy,Finally those with intermediate positions who call for the identification of sectors and projects subject to this rule in the hope of encouraging foreign investment.
