Résumé: تعتبر قاعدة الشراكة الدنيا 51/49 من الأحكام التمييزية اتجاه المستثمر الأجنبي و تشكل عائقا أمام تطور الاستثمارات في الجزائر، بالرغم من تبرير تكريس هذه القاعدة بدواعي حماية الاقتصاد والسيادة الوطنية. تهدف هذه الدراسة لتحليل و البحث في مختلف مراحل تطبيق هذه القاعدة ، بدءا بتكريسها من خلال قانون المالية التكميلي 2009 الى غاية الغاءها بموجب قانون المالية 2020 و إبقاءها فقط بالنسبة للقطاعات الاستراتيجية. The partnership rule 49/51 is considered as a discriminatory rule and a obstacle to attract foreign investments ,even it justified the application of this rule by considerations of protection and the preservation of national sovereignty. This study aims to analyze and research the various stages of applying this rule ,starting its consecration in the 2009 finance law,until its abolition in the 2020 finance law and keeping it only for strategic sectors.
